- Definition of the words
- Author
"Author" refers to a person who produces DKC
hacks distributed on this website and distributes the IPS
files.
- User
"User" refers to a person who downloads or wants
to download DKC hacks, or a person who uses or wants to
use the contract files.
- Contract files
"Contract files"
refer to all the files distributed on this website which
are downloaded and recorded on the storage medium by the
user .
- Use
"Use" refers to an operation in which a user
reads a part or all of the contract files from a storage
medium on which is recoded, or applies the IPS patch files
constituting a part of a contract files to another file.
The act of running the arbitrary file to which the user
applied the IPS patch files is also included as one of the
acts of "use".
- "Copy"
"Copy" refers to duplicating part or all of
the contract files, on storage mediums of the same or different
type.
- "Modify"
"Modify" refers to the act that user makes
modifications or additions to the contract files, or create
another file by using part or all of the contract files.
- License of use right
The author grants the user non-exclusive
license for using the contract files on condition that the user
agrees to this EULA and uses the contract files in accordance
with this EULA.
If the user does not agree to this EULA,
he/ she must not use the contract files and must discard promptly
all of the contract files in a state where they cannot be used
by third parties.
- Copy
The user is allowed copying the contract files
only for the following purposes:
- Duplication intended for use on the computer that downloaded
the contract files.
- Duplication intended for creating backup files of contract
files
.
- Modify
The user is allowed modifying the contract
files. However, the author prohibits the user from uploading
a part or all of the modified contract files or their copies
on the network, or making them accessible to public.
- Prohibition of re-licensing or transferring of use rights
Regardless of any reason, the author prohibits the user
from re-licensing or transfering his/ her license for using
the contract files, or part or all of the contract files or
their copies to third parties.
- Prohibition of redistribution
- Regardless of any reason, the author prohibits the user
from uploading a part or all of the contract files or their
copies on the network, or making them accessible to public.
- Regardless of any reason and whether or not compensation
is received, the author prohibits the user from distributing
the mediums which are recorded part or all of the contract
files or their copies.
- Contract period
- This EULA become effective at the time when the user
agrees to this and download the contract files, and it is
effective until the user stops the use of the contract files.
However, even if the user does not agree to this EULA, Articles
1, 2, 7, 8 and 14 are always in force.
- In the case where the user uses the contract files in
violation of Article 2 even though he/ she does not agree
to this EULA, all the provisions except Article 9 have effect,
and they are effective until the user stops using the use
of them.
- Obligation after contract termination
When the user
stops using the contract files and contract is terminated, the
user must discard promptly all of the contract files in a state
where they cannot be used by third parties.
- Author's responsibility
The author has the following
obligation to the user. However, the author does not have to
obligate them for contract files other than the latest version.
- Creating fixes as much as possible and providing
them to the user when the author finds fatal issues in the
contract files or receives reports on the issues from the
users.
- Not preventing users from reporting issues that they
found and asking necessary support regarding the use of
contract files.
- Final version
The author can publish the final version
of the certain contract files on his own responsibility. The
author shall have no obligation under article 9. for the contract
files after two years from their final version release.
- Disclaimer
The author does not owe any responsibility
for any damage caused by using contract files. The user uses
the contract files at his/ her own risks.
- Revision of this EULA
The creator shall be able to
revise this EULA without notice and the revised EULA will also
have effect on the contract files downloaded before the revision.
- Individual exception
If there is an EULA different
from and conflicts with this EULA in the contract files, the
EULA included the contract files will take effect.
- Supplement
This EULA revised on July 16, 2017 shall
be enforced on the same day.
